  17. The use of Win-Secure-It «  is subject to the following terms and conditions.

  19. Title To The Licensed Software
  20. ------------------------------
  21. Title to the licensed software is NOT transferred or sold to the end user.
  22. The end user is granted a non-exclusive license to use the software
  23. on a SINGLE computer or computer work station. EACH computer or computer 
  24.  
  25. work station must have its own licensed copy of the software.
  26.  
  27. Copyright Protection
  28. --------------------
  29. Win-Secure-It « is copyrighted material. It is protected by the copyright laws 
  30. of the United States, the State of California, and other proprietary rights of 
  31. Yonat Dascalu. You may not make any changes or modifications to 
  32. Win-Secure-It « or this manual. You may not decompile, disassemble, or 
  33. otherwise reverse-engineer the software in any way.
  34.  
  35. You may make copies of Win-Secure-It « only under the terms of the section 
  36.  
  37. titled "Limited License To Copy The Licensed Software".

  39. You may use Win-Secure-It « on a thirty (30) day trial basis only, provided you 
  40. do not violate the protection afforded the licensed software by the copyright laws, 
  41. and you agree to the terms of the license agreement. 
  42. If you use Win-Secure-It «  past the 30 day evaluation period you are required to 
  43. purchase it by paying the registration fee.
  44.  
  45. Limited Warranty
  46. ----------------
  47. Yonat Dascalu does not warrant that the licensed software will meet your 
  48.  
  49. requirements or that the operation of the software will be uninterrupted or 
  50. error free. The warranty does not cover any media 
  51. or documentation which has been subjected to damage or abuse by you or others.
  52. The software warranty does not cover any copy  of the licensed software which 
  53.  
  54. has been altered or changed in any way. In other words, there is no warranty either 
  55.  
  56. implied or expressed.
  57.  
  58. ANY IMPLIED WARRANTIES INCLUDING ANY WARRANTIES OF MERCHANTABILITY
  59. OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE TERM OF THE 
  60. EXPRESS WARRANTIES. Some States do not allow limitations on how long an 
  61. implied warranty lasts, so the above limitation may not apply to you.
  62.  
  63. Other Warranties
  64. ----------------
  65. The warranties set forth above are in lieu of any and all other express or implied 
  66. warranties, whether oral, written, or implied, and the remedies set forth above are 
  67.  
  68. the sole and exclusive remedies.
  69.  
  70. Limitation Of Liability
  71. -----------------------
  72. Yonat Dascalu is not responsible nor liable in anyway for any problems or damage 
  73. caused by the licensed software that may result from using the licensed software. 
  74. This includes, but is not limited to, computer hardware, computer software, 
  75. operating systems, and any computer or computing accessories. End user agrees to 
  76. hold Yonat Dascalu harmless for any problems arising from the use of the software.
  77.  
  78. Yonat Dascalu SHALL NOT IN ANY CASE BE LIABLE FOR ANY SPECIAL, 
  79. INCIDENTAL, CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES 
  80. ARISING FROM ANY BREACH OF THESE WARRANTIES EVEN IF Yonat Dascalu 
  81. OR ITS AGENTS OR DISTRIBUTORS HAVE BEEN ADVISED OF THE POSSIBILITY 
  82. OF SUCH DAMAGES. 
  83. THIS AGREEMENT SHELL BE GOVERNED BY THE LAWS OF ISRAEL AND SHELL 
  84. INURE TO THE BENEFIT OF Yonat Dascalu AND 
  85. ANY SUCCESSORS, ADMINISTRATORS, HEIRS, AND ASSIGNS. ANY ACTION OR 
  86. PROCEEDING BROUGHT BY EITHER PARTY AGAINST THE OTHER ARISING OUT 
  87.  
  88. OR RELATED TO THIS AGREEMENT SHALL BE BROUGHT ONLY IN ISRAEL. 
  89.  
  90. In no case shall Yonat Dascalu's liability exceed the license fees paid for the right 
  91. to use the licensed software, or a sum no greater than one Dollar ($1.00), 
  92. whichever is less.
  93.  
  94. Limited License To Copy The Software
  95. ------------------------------------
  96. You are granted a limited license to copy Win-Secure-It « ONLY FOR THE TRIAL 
  97. USE OF OTHERS subject to the terms of this software license agreement described 
  98. herein, and that the conditions described below are met.
  99.  
  100. * No fee, charge or other compensation may be accepted or requested by anyone 
  101.        without the express written permission of Yonat Dascalu. 
  102.  
  103. * Public Domain Disk Vendors May NOT CHARGE a fee for the Win-Secure-It « 
  104.       itself. 
  105.  
  106.  However you may include Win-Secure-It« on a diskette/CD-ROM for which you 
  107.  charge a nominal distribution fee. 
  108.  
  109.  The purchaser of said diskette must be informed in advance that the fee paid to 
  110.  acquire the diskette does NOT relieve said purchaser from paying the Registration 
  111.  Fee for Win-Secure-It« if said purchaser uses Win-Secure-It«.
  112.  
  113. * The  statement of shareware registration requirements MUST be printed on a 
  114.   label, or other form, that is directly attached to the distribution media.
  115.  
  116. * Operators of electronic bulletin board systems (Sysops) may post Win-Secure-It«
  117.   for downloading by their users without written permission ONLY AS LONG AS 
  118.   THE ABOVE CONDITIONS ARE MET.  A fee may be charged for access to the 
  119.   BBS AS LONG AS NO SPECIFIC FEE IS CHARGED FOR DOWNLOADING 
  120.   Win-Secure-It« files without first obtaining the express written permission from 
  121.   Yonat Dascalu to charge such a fee.
  122.  
  123. Evaluation and Registration
  124. ---------------------------
  125. This is not free software.  This license allows you to use this software for evaluation 
  126.  
  127. purposes without charge for a period of 30 days.  If you use this software after the 
  128. 30 day evaluation period a registration fee of 29 US Dollars is required.  Payment 
  129. can be in Cash, money order, checks Payments in checks must be in US dollars 
  130. drawn on a US bank or Israeli shekels, cash payment can be in any currency.

  138. Quantity discounts are available, as described in the section Ordering 
  139. Information/Order Form.  
  140. When payment is received you will be sent a registration key to remove all 
  141. unregistered messages and documentation and the latest version of Win-Secure-It«.

  143. One registered copy of Win-Secure-It«  may either be used by a single person who 
  144. uses the software personally on one or more computers, or installed on a single 
  145. workstation used non simultaneously by multiple people, but not both.
  146.  
  147. You may access the registered version of Win-Secure-It«  through a network, 
  148. provided that you have obtained individual licenses for the software covering all 
  149. workstations that will access the software through the network.
